Standard Terms & Conditions Throughout, You and Your will mean the person or persons commissioning work to be carried out by Paula Michelle Ltd or its subcontractors. Project shall mean the work detailed in an estimate supplied by Paula Michelle Ltd. 1 Orders for articles, materials or contractor's services will not be placed until You have signed and returned an acceptance form and supplied any required deposit. 2 Outstanding balances will be payable on day of installation or delivery of goods and services. No credit period can be given. Costs incurred by chasing and securing late or delayed payments will be payable by You and will be invoiced. 3 If prices of articles, materials or contractor's services change, before proceeding with Your work notice of any price increase will be given and confirmation of any revised price will be required. 4 Once articles, materials or contractor's services have been ordered, your order with Paula Michelle Ltd is not cancellable. 5 Whilst every effort will be made to keep a project to the proposed time plan, no responsibility can be assumed for delays occasioned by failure of others to meet commitments or for any other reason or cause beyond the control of Paula Michelle Ltd. 6 Designs, specifications, samples, drawings, ideas and mock-ups are offered on a non-exclusive basis and will remain the property of Paula Michelle Ltd, whether or not the work for which they are made is executed, until Your account is settled in full. Special provision can be made for those wishing to purchase only designs and ideas. 7 Paula Michelle Ltd does not guarantee articles or materials above or beyond the guarantee offered by the manufacturer. You shall have benefit (in Your sole expense in the assertion thereof) of all warranties, guarantees and assurances possessed by Paula Michelle Ltd against suppliers, manufacturers and contractors. 8 Obtaining, installing or commissioning articles, materials and contractor's services are subject to the ability of Paula Michelle Ltd being able obtain same and/or to procure necessary labour; and is contingent on strikes, accident and emergency or other causes beyond the control of Paula Michelle Ltd. 9 If Paula Michelle Ltd is required to render any services not initially contemplated in the planning of the Project or incurs costs which are unavoidable, unforeseen or due to changes ordered by You, Paula Michelle Ltd shall be paid for such extra costs or services at reasonable value. Every effort will be made to inform you of any extra or additional costs before they are incurred. 10 If a Project Management fee is being charged the agreed percentage will be added to the final overall cost of the project and will be payable when the project is fully completed. 11 The extent of supervisory services provided during Project Management is wholly at the discretion and professional opinion of Paula Michelle Ltd. Paula Michelle Ltd can not be obligated to render full day-to-day supervisory services, however in addition to planning the schedule of works, endeavouring to keep all works on schedule and liaising between contractors, Paula Michelle Ltd will brief all contractors on site prior to their starting each stage of work and will supervise installation of unusual, difficult or tricky aspects of the Project.
